Effective Date: June 2025

This Creator Agreement ("Agreement") is a binding contract between you ("Creator", "you") and xxthree ("xxthree", "we", "us", or "our").

By creating a creator account on xxthree, you agree to this Agreement in addition to our Terms of Service, Privacy Policy, Acceptable Use Policy, and Copyright Policy.

1. Eligibility and Verification

• You must be 18 years or older.
• You must successfully complete our identity and age verification process using a valid government-issued ID (e.g., NIN, Driver’s License, International Passport).
• You are responsible for providing accurate information and updating it when necessary.

2. Content Standards and Compliance You agree to upload only content that:

• You own or have full legal rights to use.
• Features participants who are all 18 years and above with documented consent.
• Complies with our Acceptable Use Policy and Nigerian laws.

Safe For Work (SFW) Content Creators who publish in the SFW mobile app or SFW section must ensure all content is appropriate for general audiences (no nudity, sexual acts, or sexually suggestive material).

We reserve the right to review, remove, or restrict any content that violates our policies.

3. License Grant By uploading content to xxthree, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, distribute, and display your content on the platform.

You retain full ownership of your content.

4. Revenue Sharing and Payments

• You set your own prices for subscriptions and paid content.
• xxthree charges a 15% platform fee on gross earnings.
• You will receive the remaining 85%.
• Payouts are made via Paystack, Flutterwave, bank transfer, or other available methods.
• Minimum payout threshold and processing fees may apply.
• You are fully responsible for reporting and paying all taxes applicable to your earnings in Nigeria.

5. Account Termination

• You may close your creator account at any time.
• We may suspend or terminate your account, remove content, or withhold payouts if you violate this Agreement or any of our policies.
• After termination, we may continue to use content that was already posted on the platform.

6. Creator Responsibilities You agree to:

• Maintain the security of your account.
• Not engage in fraudulent activities or misleading practices.
• Respect other creators and users.
• Comply with all applicable Nigerian laws.

7. Disclaimers

• We do not guarantee any minimum income or level of visibility for your content.
• You use the platform at your own risk.
• xxthree is not liable for any lost earnings or opportunities.

8. Governing Law This Agreement is governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved in any court here in Nigeria.

9. Amendments We may update this Agreement from time to time. We will notify you via email or in-app notice. Continued use of the platform after such updates means you accept the changes.
